Guantanamo Bay

The place has come to signify America’s war on terrorism. This is the place they take suspected terrorist to let them experience fun activities. What we read about and what is going on may be two different things. However as this war goes on, a new front has been opened, and that front is in front of a judge.

In a Quick summary the Supreme Court ruled Thursday that foreign detainees held for years at Guantanamo Bay in Cuba have the right to appeal to U.S. civilian courts to challenge their indefinite imprisonment without charges. This is unusual in itself as that the Supreme Court issued a ruling on a Thursday. Historically rulings are handed down on a Monday.

Because of this ruling, there will be significant changes with America’s war on terrorism. The fallout of that is still to be realized. One thing that may happen is, It may take longer to get useful information thus making it useless.

There are points on both sides of the argument and it is hard to truly say who is right as Guantanamo Bay is so covered in a cloak of darkness.

    Rather ironic how this Administration, that will take every opportunity to trumpet on about how the US is a “beacon of democracy” and how the US upholds the principle of ” justice” can, for years, detain and torture “terrorists” or “enemy combatants” (another Pentagon buzzword) without charge or trial,and without legal representation or access to legal representation whatsoever.

    Exactly who, determines these detainees as “terrorists” and “enemy combatants” ? The same “liars” that invented Saddam Husseins’ WMD?

    Since it was the U.S. Military that invaded Afghanistan, in the first place, it would seem that these detainees would be well within their rights under international law to stand and fight an invading army.

    Or, would it be more preferable to the Neo-Cons in Washington, that every young Muslim man capable of being a soldier in far-off lands, anoint the feet of US soldiers in reverence of their noble quest, as great bastions of righteousness, upon their arrival?

    Exactly where is the crime?

    The invasion of Afghanistan is simply a kneejerk reaction resulting in seven years of bumbling efforts by a fascist regime as “payback” for a crime (9/11), the perpetratrators of which, will never be brought to justice.

    Therefore, the Neo-Con fools in Washington want to make up for their own ineptitude by showing the world that they can do whatever they want, whenever they want, including holding people without charge or trial for years, in full violation of International law.

    And this bogus defence of “well, Guantanamo is not on U.S. soil” malarkey, would further illustrate their arrogance, knowing that the maintenance of this facility can and should constitute war crimes under International Law.

    On the other hand , since it is the American taxpayer that is funding the maintenance of Guantanamo Bay, then surely it would seem that the operation of such a hideous facility, should operate under the scrutiny of the U.S. Justice system, and therefore, anyone detained there should be afforded all of the rights and privileges of anyone accused of a crime ………under U.S. law.
